RT300 Ergometer Limited Warranty (Australia)

Definitions
In this warranty:
1.    "Act" means the Commonwealth Trade Practices Act 1974 as amended
2.    "Back to Base" means where delivery to and collection of your product from Restorative Therapies or an authorized agent
3.    "Consumable" includes (without limitation) electrodes.
4.    “Restorative Therapies” means Restorative Therapies, Inc
5.    "Refurbished" means a Product sold by Restorative Therapies as a second.
6.    "Genuine" means manufactured by or for Restorative Therapies.
7.    "Product" means a Genuine Product supplied new by Restorative Therapies.
8.    "Purchase Date" means the date of first purchase from Restorative Therapies.
9.    "Service Agent" means an authorised Restorative Therapies service agent
10.    "You" means the End User and "your" has a corresponding meaning.

Introduction
Subject to these conditions, Restorative Therapies offers this Warranty on a Product to which its service applies.
This Warranty applies in addition to the conditions and warranties implied by the Act in relation to a Product.
Restorative Therapies will not be liable for any consequential loss, indirect or special damage arising from your use of the Product.

Warranty
Restorative Therapies warrants that your Product will be free from defects in materials or workmanship for two (2) years from your Purchase Date.
At its discretion, Restorative Therapies will repair or replace your Product, if it does not comply with this Warranty.

To make a Warranty claim, you must:
1.    First call Restorative Therapies on 02 8006 0939;
2.    At our discretion we will either send you a replacement for the defective component of your system or ask you to return the Product (if warranty service is required) in its original packaging (or suitable alternative) to a Restorative Therapies or a designated Service Agent, as directed by Restorative Therapies.
3.    If the defective product needs to be returned then you are responsible for the delivery of your Product to and its collection from Restorative Therapies or the Service Agent.

Warranty Application
This Warranty applies only:
a.    To a Product that is supplied to You by Restorative Therapies or approved distributor;
b.    If you use the Product for your own private or business purposes; and
c.    You have not bought the Product for resale.

Warranty Exclusions
This Warranty will not apply if during the warranty period:
a.    A Product's serial number or any rating label is removed or changed in any way;
b.    A Product is repaired other than by Restorative Therapies or our Service Agent;
c.    You use a Product contrary to any technical or operating environment guidelines recommended in its user guide;
d.    A part in your Product, (including without limitation the electrodes), reaches the end of its service life;
e.    A Product's malfunction or failure results from:
 
1.    deliberate or accidental damage;
2.    neglect or modification;
3.    incorrect voltage or a power surge; or
4.    your use of any non-genuine Consumables, software, parts, accessories or interfacing.

Non-Genuine Items
Restorative Therapies advises that if you use non-Genuine Consumables, software, replacement parts or accessories, you may damage your Product and may void your warranty.
